The management company at my complex is notoriously dishonorable and can not be trusted. I know that when I move they will try to keep my deposit and will devise reasons (i.e. lies) for costs of damage as that is what they have done to other tenants.
A friend suggested I move out without notice, not pay my last month rent and let them keep the deposit. What kind of repercussions could I face in doing so? And how long after the first of the month do I have before I must move? I know the purpose of a deposit is in case someone leaves in this manner but you just never know.
Any word to the wise? In case it is relevant I live in California. Thanks!
By the way… my lease is month to month right now and there is no details as to how many days notice I am required to give, etc.., more
and Open Question: Can I use security deposit as last month's rent in NYC? I’m moving out of my apartment in Brooklyn at the end of April and I e-mailed my landlord to ask whether I can use my security deposit as last month’s rent. She said this is illegal. However, I’m paying rent in the new place and I don’t really have the money to pay her for April rent. Plus, she doesn’t like me and I’m really not sure if she’ll give me back my deposit. What do I do- scrounge up the money somewhere? Or take a chance that she’ll just not have time to evict me by the time I leave? (She lives downstairs…). So, do I just ignore her and not pay my rent for April and move out? or should I just try to pay it and hope she’ll give me back my deposit? Is it actually illegal to use security as last month’s rent in NYC?
also, I’m out of the country from April 3-13th. How will that affect her ability to give me the 3day pay/quit notice?
reenz- how can an eviction happen in 10 days? Between the 3day notice, then filing the papers, then waiting for a court date, then if the landlord wins, waiting for the marshall to deliver the papers to me, plus not counting weekends, how is this possible?
My parents are landlords in Florida, which is a VERY landlord friendly state (as opposed to NY), and even there it takes at least a month for all the paperwork to go through., more
